Terms of Service

These terms govern your use of this website and the services provided by DigiOn Solutions Pvt. Ltd. (“DigiOn”, “we”, “us”). Where you sign a separate services agreement or statement of work with us, that agreement takes precedence over these terms if the two conflict.
The short version. We build and run an AI receptionist for your business. You pay monthly. You can cancel anytime with no notice and no questions, and you keep everything we built. We don't guarantee specific revenue results, and figures on our website are estimates, not promises.
1. The service
DigiOn configures, deploys and manages an AI-powered call-answering system for your business. Depending on the plan you select, this may include call answering and qualification, appointment booking into your field-service software, emergency escalation, missed-call text-back, quote follow-up, review requests, reactivation campaigns, and paid advertising management.
2. Fees, billing and cancellation
- Plan fees are billed monthly in advance in US dollars. Current pricing is published on our website and confirmed in your order.
- The initial build — discovery, call-flow design, integration and testing — is included in your plan at no separate charge.
- If we do not have your system live within 7 days of receiving the information we ask for at intake, your first month is free. Delays caused by outstanding information from you do not count toward those 7 days.
- You may cancel at any time, with no notice period and no cancellation fee. Tell us and you will not be billed again.
- Cancellation stops future billing. Fees already paid for the month in progress are not refunded on a pro-rata basis, and service continues to the end of that paid month.
- Advertising spend under a Full Stack plan is paid by you directly to the advertising platform. We do not mark it up.
- Fees are exclusive of any taxes, which are your responsibility where applicable.
3. What you keep if you leave
On cancellation, you retain — and we will export within 7 days of request — the call flows and prompts built for you, your call recordings and transcripts, your CRM and lead data, and any telephone number we provisioned on your behalf, subject to carrier porting requirements.
4. Your responsibilities
- Accurate information. Your services, pricing bands, service area, hours, emergency definitions and on-call arrangements must be accurate and kept current. The assistant can only be as correct as what you tell it.
- Lawful call recording. You are responsible for ensuring that recording calls to your business line is lawful in your jurisdiction. We configure a recording and AI disclosure at the start of every call.
- Consent for outbound contact. Where we send messages or place calls to your customers on your behalf, you warrant that every number you provide or capture was collected with the consent required by the Telephone Consumer Protection Act and applicable state law, and you will indemnify DigiOn against claims arising from numbers supplied without that consent.
- Access. You will provide timely access to the systems we need to integrate — your phone provider, calendar and field-service software.
- Acceptable use. You will not use the service for unlawful, deceptive or harassing communications.
5. Fair use
Plans described as including unlimited calls are subject to fair use. Fair use means call volumes consistent with a home-services business of your size. If your volume materially exceeds that — for example through campaign spikes, robocall traffic or a shared line serving multiple businesses — we will contact you to agree an appropriate plan before making any change. We will never issue a surprise overage invoice.
6. No guarantee of results
The revenue calculator on our website produces an estimate based on figures you enter. It is not a projection, a quotation or a guarantee. Industry statistics are drawn from the third-party sources cited alongside them. Results in home services depend on your pricing, market, capacity, close rate and how quickly your team acts on the leads we deliver.
We do not guarantee any specific number of calls answered, appointments booked, or revenue earned.
7. Compliance
Our systems are deployed inbound-first: answering calls placed to your own line. The FCC treats AI-generated speech as an artificial voice under the TCPA, and consent obligations apply most strictly to outbound calling. Every call opens with an AI and recording disclosure. Outbound messaging is sent only to consented numbers, logged with a timestamp.
Nothing on our website or in these terms is legal advice. You should confirm your own obligations with your attorney. We do not currently support HIPAA-regulated workloads and do not sign Business Associate Agreements.
8. Intellectual property
DigiOn retains ownership of its underlying methods, templates, tooling and platform. You own your business data, your call recordings and transcripts, your customer lists, and the call flows configured specifically for your business. Website content, design and copy are DigiOn's property and may not be copied without permission.
9. Confidentiality
Each party will keep the other's non-public business information confidential and use it only to perform under these terms. This obligation survives termination by two years.
10. Third-party services
The service depends on third parties including telephony carriers, voice AI providers and your field-service software. Interruptions to those services may interrupt ours. We are not liable for outages, changes or failures caused by third-party providers, though we will work in good faith to restore service promptly.
11. Warranties and liability
The service is provided with reasonable skill and care. Except as expressly stated, it is provided “as is” without further warranty of any kind.
To the maximum extent permitted by law, DigiOn's total aggregate liability arising out of or relating to the service is limited to the fees you paid to us in the three months preceding the event giving rise to the claim. Neither party is liable for indirect, incidental, special or consequential damages, or for lost profits or lost business.
12. Suspension and termination by us
We may suspend or terminate the service on written notice for non-payment, for breach of these terms, or where continuing would expose either party to legal risk. Where we terminate without cause, we will refund any prepaid fees for the unused portion of the month.
13. Governing law and disputes
These terms are governed by the laws of India. Any dispute arising out of or relating to these terms will be finally resolved by arbitration seated in Singapore under the SIAC Rules, before a single arbitrator, conducted in English. Either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property or confidential information.
14. Changes to these terms
We may update these terms. Where a change materially affects an active client, we will give 30 days' notice by email, and you may cancel before the change takes effect.
